Christian Louboutin Appeals Again

In 2011, Christian Louboutin launched a heated discussion with the YSL about the "red shoes" in the fashion circle. In January of that year, the famous French shoe shoe brand Christian Louboutin company had asked the YSL to stop using the red bottom after seeing rival YSL selling the women's shoes in the exclusive store in Manhattan, but it did not get the YSL response.

ChristianLouboutin reluctantly sued the court in April, demanding that YSL compensate for the loss of 1 million US dollars on the grounds of "illegal competition" and "trademark infringement", and ordered the court to order YSL to stop producing all red shoe.

However, in August of the same year, the federal court finally ruled that it was red.

The bottom is not its prerogative.

The federal court dismissed the prosecution of Christian Louboutin, saying that although the red sole had its own characteristics, it could not be regarded as an exclusive "trademark".

This result is clearly not a good result for Christian Louboutin.

So in September the following year appealed again, the court decided the result is: Christian Louboutin has the patent of red shoe, but when other brand design shoes are red as a whole, it is not infringing.

Since then, Yves Saint Laurent has said through a lawyer, "waiver of counterclaim against Christian Louboutin", and in the media release, said, "while terminating the lawsuit, I hope that the court will not make further ruling, so that the designer will not be brought into a lawsuit because of the use of colors in individual cases."

It was thought that such a result brought about the battle of the lawsuit. In 2013, Christian Louboutin discovered many so-called plagiarism cases involving Charles Jourdan, DSW and other brands.

Again unable to sit up and appeal again, I hope that through legal means to protect their brand of red shoe brand property, the result of the toss is unknown, we look forward to it!
